This, again, primarily depends on Dutch private international law.

First, it must be determined whether the Dutch court has jurisdiction. Then, the question arises which law applies to your assets (and possibly debts).

If Dutch law applies to your marital property regime, you were married before January 1, 2018, and you have no prenuptial agreement stating otherwise, you each generally have the right to 50% of the assets (and debts). Under Dutch law, all assets and debts acquired by you and your spouse during the marriage are considered joint property and are divided equally upon divorce.

If you own a home, it also falls under the community of property. If there is equity in the property and one of you wants to keep the house, the other is entitled to half of that equity. If you prefer to sell the property, both of you are entitled to half of the proceeds.

It is also possible that the Dutch court has jurisdiction over the division of your marital property, but that the law of, for example, your joint nationality (and not Dutch law) is applicable. This means that, unless you agree to apply another legal system, your assets and debts will be divided or allocated according to that national law.

Did you make a prenuptial agreement? The Dutch court will in general respect this prenuptial agreement and this agreement will then be leading for the allocation of the assets and debts.

If Dutch law applies (or is chosen), maintenance calculations must be made, taking into account both your income and that of your partner, both during the marriage and after the divorce. These calculations are used to determine the amounts for child support and spousal support. There is now a substantial body of case law in this area, including cases involving international divorces, where the calculations can often be more complex.

Child maintenance is paid net of tax when you live in the Netherlands, while maintenance for ex-spouses is paid gross (before tax). This means that you, as the receiver, are liable for the tax, even if your ex-spouse is unable to deduct the maintenance payments.

Any transfer of property that takes place as part of the division of the matrimonial estate is tax-free. However, if you are married under the Dutch community of property regime and wish to deviate from a 50/50 division, there is the risk that tax may be levied. So, one should be cautious here.
