What happens to the dog when you get divorced in the Netherlands?
Some expat pet owners face a dilemma: Who will get Tommy? The lovely family dog, where will he live? For instance: will he be where the children are? Can you agree on some kind of visitation arrangement? Can you make official agreements about this in the Netherlands? And where do you do that?
Agreements about pets in a divorce agreement in the Netherlands
First, of course, you’ll discuss where each of you, and the children, will live. Once that’s clear and agreed upon, you can also make arrangements about Tommy. I can then record those agreements for you in the divorce agreement. For example: who will Tommy live with, how will you divide the costs, and will Tommy spend a few weeks with the other (ex-)partner during the holidays?
Expat Mediation: clear arrangements about expat pets as well
In a Dutch court case, it generally comes down to the judge having to determine who is, or remains, the legal owner of Tommy.
Under Dutch law, there is, strictly speaking, no legal basis for a visitation schedule, as the law only provides for contact arrangements with children.
Fortunately, in mediation you can make your own agreements about your beloved pet. That applies, of course, not only to Tommy the dog, but also to your cat, kitten, or rabbit.
